Lotterywest operates according to the provisions of the Lotteries Commission Act 1990 (as amended), as a statutory authority responsible for the selling of lottery games and distributing the proceeds for the benefit of the Western Australian community.

Game Legislation

When you play Lotterywest games you agree to be bound by the Rules governing those games. If any conflict should occur between the Rules and information contained on this website, in the Lotterywest App or in a game brochure, the Rules must take precedence. Lotterywest Membership Terms and Conditions

The Lotterywest Membership Terms and Conditions apply to all aspects of your transactions with us. To register as a player, you must read, understand and agree to these Terms and Conditions.

Amendments were made to the Lotterywest Membership Terms and Conditions which take effect from 15 July 2021. The Terms and Conditions were amended as follows:

  • Clause 8.1 – to include Paypal as a potential means of depositing funds into an E-wallet. Lotterywest will advise Lotterywest members when the Paypal functionality is available.
  • Clause 8.7 – to clarify that money held in E-wallets is held separately from funds used by Lotterywest and TMS Global Services Pty Ltd (the provider of the www.oz.lotterywest.com website and the Oz.Lotterywest App) (TMS) for general business and operational purposes.
  • Clause 10.1 – to clarify that a person must be a Western Australian resident at the time of purchasing a ticket online or on the App.
  • Clause 16 – to update the privacy provisions in relation to marketing and the use of a Lotterywest member’s personal information. These changes make it clear that:
    • Lotterywest marketing activities include marketing via social media;
    • Lotterywest, TMS and social media providers may contact Lotterywest members by various means, including via social media, for marketing and research purposes;
    • A Lotterywest member may opt-out of marketing communications by unsubscribing in their account on the Lotterywest website;
    • Lotterywest and our marketing and social media providers may track a Lotterywest member’s online activity (including on social media platforms) to undertake research and marketing activity.
  • Clause 17 – to update the privacy provisions in relation to disclosure of a Lotterywest member’s personal information to third parties. These changes make it clear that:
    • A Lotterywest member’s information collected by Lotterywest, TMS or our marketing and social media providers may be provided to marketing agencies and media providers (including social media providers) for a number of purposes, including for marketing via social media; and
    • Lotterywest is not liable for misuse of a Lotterywest member’s information by service providers and marketing and social media providers.
  • Clause 18 – minor amendment to clarify that Lotterywest does not store a Lotterywest member’s credit card details.

As provided in clause 4.5 of the Lotterywest Membership Terms and Conditions, you will be deemed to have received this Notice of amended Terms and Conditions on 15 July 2021.

We are committed to upholding high standards of privacy, data protection and maintain our accreditation through the World Lottery Association's Security Control Standard and appropriate State and Federal laws. Amendments were made to the Lotterywest Privacy Policy which take effect on 15 July 2021 to clarify how Lotterywest deals with personal information. The main amendments to the Privacy Policy are as follows:

  • How we use your information: Clarification that Lotterywest may use your personal information for marketing, including via social media.
  • Who we disclose your information to:
    • Clarification that your personal information may be used to send you marketing or promotional material either by Lotterywest or on behalf of Lotterywest;
    • Clarification that Lotterywest may provide your personal information to external service providers we use to assist in managing, operating and marketing our business and business systems, including to media providers (including social media providers); and
    • Clarification of when Lotterywest may disclose your information to other organisations.

The amended Lotterywest Privacy Policy comes into effect on 15 July 2021.
