Play Online - Terms and conditions of use.

These terms and conditions apply to all aspects of your transactions with us. In order to apply for registration as a player, you must read these terms and conditions and if you understand and agree to all of them, click on the terms and conditions checkbox at the bottom of the “Application for Registration” page.

1. Definitions

  1. In these terms and conditions unless the contrary intention appears:

    • “Act” means the Lotteries Commission Act 1990 (as amended);
    • “Account” means the player’s Play Online account with us;
    • “App” means application software for use on smartphones, tablets and other mobile devices;
    • “Deadline” means the day and time of day after which offers to purchase Entries will not be accepted;
    • “Entry” means an entry or entries into lottery games conducted by Lotterywest pursuant to the Act;
    • “Notice” means a notice given in accordance with clause 4 of these terms and conditions;
    • “Lotterywest” means Lotteries Commission of Western Australia, trading as Lotterywest ABN 78 531 150 466, 74 Walters Drive Osborne Park 6017 Western Australia;
    • "Lotterywest App" means the Lotterywest App which connects the Player to the Play Online service on the Lotterywest Website;
    • “Lotterywest Rules” means rules made by Lotterywest for the conduct of public lottery games;
    • “Play Online Website” means the Play Online service which sits within the Lotterywest website;
    • “Player” means a person who is lawfully entitled and is registered to Play Online;
    • “Us” and “We” means Lotterywest;
    • “You” and “Your” means the player.

2. Introduction

  1. Lotterywest is a statutory authority responsible for selling lottery games and distributing the proceeds for the benefit of the Western Australian community. We are the official state lottery for Western Australia and we operate the Play Online Website and the Lotterywest App.
  2. The rules governing the Lottery games conducted by Lotterywest are made in accordance with the Act.
  3. These terms and conditions apply to all aspects of your transactions with us.
  4. In order to apply for registration as a player, you must read these terms and conditions and if you understand and agree to all of them, click on the terms and conditions checkbox at the bottom of the “Application for Registration” page. You must also follow the instructions for completing the "Application for Registration” which may include an online process or an offline process.
  5. By selecting the terms and conditions checkbox you represent to us that you have read, understood and accept that you will be bound by the terms and conditions.
  6. Registration occurs only when we accept your Application for Registration.
  7. Upon registration you will become a player of Play Online.
  8. Players may participate in and offer to purchase an Entry through us; and
  9. If you require assistance with or explanation of any of these terms and conditions, we advise that you seek expert independent legal advice.

3. Warning, warranty and indemnity

  1. The laws and/or rules applicable in your place of residence may prohibit you from purchasing Entries from us. Some jurisdictions have laws which prohibit you from purchasing Entries from us. Other jurisdictions have laws which prescribe age requirements for purchasing Entries from us, and other jurisdictions have laws which operate in other ways to prevent you from purchasing Entries from us.
  2. We do not wish to violate any such law nor allow you to make an Application for Registration or to purchase Entries from us where your doing so would violate any such law. If you are a resident of any jurisdiction where you are subject to any such law, you must not make an Application for Registration or purchase Entries from us.
  3. When you make an Application for Registration and each time you make an offer to purchase an Entry from us, you warrant to us that you are legally entitled to;
    1. apply for registration, or
    2. deposit funds with us, or
    3. purchase the Entry and to receive winnings from us, and
    4. that all of the above will not in any way violate any applicable laws of your place of residence or from where you are initiating the transaction.
  4. We do not agree to:
    1. accept your Application for Registration, or
    2. to accept your deposit of funds, or
    3. to accept your offer to purchase an Entry, or
    4. to pay you any winnings;
    while you are prohibited from any such law from any such activity. In accepting your Entry we are relying on this warranty.
  5. When you make an Application for Registration you provide us with certain information. It is your responsibility to inform us of any changes to the information you have given us.
  6. We rely on this information being true and correct and not misleading. If the information is untrue, incorrect or misleading in any way, we may cancel your registration or cancel any Entry purchased by you or offers to purchase an Entry from you, and we may retain (or recover from you) the value of those Entries and any winnings paid to you and we may suspend and/or exclude you from being able to make any further purchases of an Entry.
  7. By making an Application for Registration, you authorise us to make such enquiries at our discretion to verify the personal information provided by you.

4. Our Agreement with you and the applicable law

  1. When you make an Application for Registration, you are making an offer to us in Western Australia to enter into an agreement with you on these terms and conditions.
  2. If we accept your Entry, an agreement between you and us is formed in Western Australia, based on the terms and conditions and governed by the laws of Western Australia and subject to the exclusive jurisdiction of the courts of Western Australia.
  3. Every time you offer to purchase an Entry from us, you are doing so in Western Australia pursuant to these terms and conditions and we are accepting that offer in Western Australia.
  4. These terms and conditions and our agreement with you may be varied at any time in the following manner:
    1. We will give you a Notice setting out the variation and the date on which it will take effect;
    2. The Notice will be posted by us in the Play Online Website;
    3. You will be deemed to have received the Notice at the time that it is posted in the Play Online Website.
  5. When you offer to purchase an Entry from us after you are deemed to have received Notice, you are doing so in accordance with the varied terms and conditions.
  6. We further reserve the right, without Notice, to amend the Play Online Website pages and other procedures and information on or accessible from the Play Online Website.

5. Responsibility for your Play Online account and security

  1. You are responsible for all of the obligations arising out of or in relation to your registration and your Play Online account.
  2. When you successfully complete your Application for Registration, your player identification will be confirmed by email to the email address specified in your Application for Registration.
  3. You must enter your email address and password (or PIN if you are using the Lotterywest App) in order to access your Play Online account details and each time you offer to purchase an Entry from us.
  4. It is your entire responsibility to ensure that your login details for Play Online are not disclosed to any other person, nor your answers to your security question(s).
  5. If installing the Lotterywest App it is your responsibility to ensure that the Lotterywest App is only installed on a smartphone, tablet or other mobile device with standard operating systems and settings, with only approved applications installed.
  6. Lotterywest will not be responsible for any inability of your computer, smartphone, tablet or other mobile device to access or use the Play Online Website, or for any loss or damage to these devices resulting from your access, use or attempted use of Play Online.

6. General registration information

  1. You will only be able to offer to purchase an Entry from us to qualify for prizes in selected lottery draws if you have completed an Application for Registration and we have accepted your Application for Registration.
  2. Upon our acceptance of your Application for Registration, we will open a Play Online account for you in your name only, you will be able to make deposits into your Play Online account and you will be able to offer to purchase an Entry from us using your Play Online account. We do not guarantee to accept an offer you make to purchase an Entry from us and we may refuse to do so in our absolute discretion without notice and without giving reasons.
  3. Registration as a Play Online account holder does not qualify you for Lotterywest Players Registration Card (PRS) membership.
  4. You can make an Application for Registration to have a Play Online account if:
    1. You are an individual person (Play Online accounts will only be opened in the names of individuals);
    2. You are at least 16 years of age;
    3. You reside in Western Australia;
    4. You have an email address that is not already registered with Play Online;
    5. You have an authorised financial institution account;
    6. You do not currently have a Play Online account (multiple Play Online accounts for a single individual are not allowed); and
    7. Your Play Online account is not currently blocked.

Information and procedures on proof of identification, age and residence requirements are included in the Play Online website at ‘Registration’ and ‘Frequently Asked Questions’ (FAQ).

7. Online registration

  1. To register online you must complete and submit the Application for Registration found on the Play Online website
  2. Your identification will be verified through a third party - GreenID, our approved electronic identification service, which has an agreement with us for this purpose. GreenID is provided by Deloitte Digital Pty Ltd which provides and maintains software which will validate the identity of an individual online, against various databases such as Electoral Rolls, White Pages, Medicare, Australian Passports and Western Australian Driver’s Licences.
  3. As part of the registration process you will be directed to the GreenID website where identification checks are performed in an interactive manner.
  4. Once the verification process is complete and successful, we will send you an email, to the email address you have provided us, with details of your temporary password to enable you to login and complete your registration.

If you do not complete the registration within 30 days, your registration details may be purged and deleted from the system.

8. Offline registration

  1. If you are unable, or prefer not to complete the Application for Registration online for any reason, you may be able to register offline.
  2. To register offline, you must click the ‘Register offline’ button on the Play Online website. You will then be issued with a Play Online application number which you should note and record. You will then be required to download, complete and print the Application for Registration form available on the Play Online website.
  3. You are required to send the completed Application for Registration form, together with two suitable forms of identification to Lotterywest by mail: Lotterywest, 74 Walters Drive, Osborne Park, WA, 6017; or by fax: 08 9340 5242; or by email: playonline@lotterywest.wa.gov.au
  4. Your identification may be verified via GreenID by Lotterywest.
  5. Copies of two of the following forms of identification must be provided to Lotterywest as proof of identity (that will verify name, address and date of birth) with at least one of the documents coming from Category A.

    Category A:

    • Passport
    • Driver's Licence
    • Birth Certificate
    • Marriage Certificate

    Category B:

    • Evidence of an account with Australian financial institution in your name and address (issued within the last 6 months)
    • Utility invoice (electricity, gas, water or telephone account) in your name and address (issued within last 6 months)
    • Services notice (rates notice, land tax valuation notice, insurance premium notice, internet service provider statement, vehicle registration document (issued within last 6 months)
    • Medicare card
    • Proof of age card
    • Electoral enrolment card/letter
  6. If your name is not the same on any of the forms of identification sent to Lotterywest, you will also need to include a copy of the relevant change of name documentation (e.g. a Marriage Certificate or deed poll) with your completed Application for Registration form.
  7. If you do not supply information as detailed above within one month, your Application for Registration may be deleted from the system.
  8. Once the verification process is complete and successful, we will send you an email, to the email address you have provided us, with details of your temporary password to enable you to login and complete your registration.

If you do not complete the registration within 30 days, your registration details may be purged and deleted from the system.

9. Depositing funds into your Play Online account

  1. A registered Play Online player can deposit funds with Play Online for the credit of their Play Online account by using BPAY® (using funds from a transaction account at an authorised deposit taking institution) or by depositing funds directly into their Play Online account using a Visa or Mastercard credit card or debit card.
  2. Some financial institutions may treat funds transferred from a credit card as a cash advance and charge interest and/or fees from the time of transfer. It is your responsibility to check with your financial institution to clarify how they deal with credit card transfer of funds to a lottery site.
  3. Minimum and maximum deposit limits and Play Online account balance limits apply and are listed in the Frequently Asked Questions (FAQ) pages, accessible in the Play Online Website.
  4. Interest is not paid on deposits or prizes held on behalf of Play Online players.
  5. Deposits cannot be made at Lotterywest retail stores.
  6. No credit is available on your Play Online account. It is your responsibility to ensure that there are sufficient cleared funds in your Play Online account in advance to cover all available transactions.

10. Purchasing entries

  1. As a registered Play Online player, the following conditions apply for purchasing Entries:
    1. There must be sufficient funds in your Play Online account to enable purchase;
    2. The purchase must not result in the total of the purchases made by you in any 7 consecutive day period exceeding $500;
    3. You must not be self-excluded and/or your Play Online account must not be suspended or closed.
  2. When you click on the “Purchase” button in the Play Online Website you are offering to purchase the Entry selected and you give us the authority to debit your Play Online account with the cost of the Entry.
  3. When purchasing an Entry, the order in which funds will be drawn down from your Play Online account to pay for the Entry will be firstly from your ‘Cash in – credit card’ pocket, then if applicable, from your ‘Cash in - BPAY®’ pocket and finally, if applicable, from your ‘Winnings’ pocket.
  4. On receipt by us of your offer to purchase an Entry, the Lotterywest computer system will attempt to give effect to your offer to purchase an Entry from Lotterywest. When we confirm acceptance of your offer, we will provide you with relevant details relating to the Entry.
  5. Offers from you to purchase an Entry must be received by our computer system prior to the Deadline for submission of offers relating to the relevant lottery draw.
  6. Lotterywest is not liable for loss of any nature (including loss of chance) that results from a delay –
    1. In transferring funds from an authorised financial institution account to a player’s Play Online account; or
    2. In processing the purchase of an Entry; or
    3. In transferring funds from a player’s Play Online account to an authorised financial institution account.
  7. It is your responsibility to satisfy yourself before purchasing an Entry that all the details of the Entry shown on the relevant page of Play Online are correct. There is no facility in the Play Online Website for a player to cancel their own Entry.
  8. Players will only be able to purchase Entries through Play Online during the Play Online operational hours. These are available in the Play Online FAQs on the Lotterywest website and may be subject to change.
  9. We will endeavour to ensure (but cannot guarantee) that the hours relating to the availability of Play Online will be as specified.

11. Prizes

  1. We will send an email to your nominated email address if you win a prize equal to or over $1,000 advising you to check your Play Online account. This does not apply to 1st Prizes or Division 1 prizes.
  2. All prizes, other than 1st Prizes or Division 1 prizes, will be credited to your Play Online account within 24 hours of the draw in which the prize was won.
  3. 1st Prizes or Division 1 prizes are subject to provisional payout periods. Lotterywest will advise a 1st Prize or Division 1 winner on the prize claim procedure for 1st Prizes or Division 1 prizes.
  4. Prizes won via Play Online cannot be claimed at a Lotterywest store.
  5. We reserve the right to reverse or place a Stop Payment on any payment that is issued to you or to temporarily block your Play Online account if we consider that payment or continuance of your Play Online account is illegal or constitutes an offence.
  6. We further reserve the right to withhold payment of any nature and to void all winnings of a Play Online account holder if the player registration details are false or misleading.
  7. Lotterywest will not publish the name and address of any player who wins a prize unless the player informs us in writing that their name and address may be published.

12. Withdrawing funds from your Play Online account

  1. You can make withdrawals from your Play Online account to your nominated financial institution transaction account. Transfer of funds can take up to 3 working days.
  2. Minimum withdrawal limits apply and are listed in the Frequently Asked Questions (FAQ) pages, accessible on the Play Online website.
  3. When you withdraw funds, the first pocket in your Play Online account drawn down is your ‘Winnings’ pocket, then your ‘Cash in - BPAY®’ pocket.
  4. You cannot withdraw funds from your Play Online account that have been deposited using a credit card or debit card. Such funds can only be used to purchase Entries in lottery draws.
  5. Prizes or funds withdrawn from a Play Online account cannot be transferred to a credit card. They must be transferred to a transaction account at an authorised deposit taking institution.

13. Suspension or closure of your Play Online account

  1. We may suspend or close your Play Online account at any time without notice and without giving you any reason.
  2. If your Play Online account is closed, Lotterywest must remit to you any amount payable by law.
  3. Except as otherwise stated in these terms and conditions, in the event of death, the balance of the player’s Play Online account will automatically form part of the deceased estate. Claimants will be required to supply proof of entitlement in a form acceptable to us.
  4. You can choose to close your Play Online account at any time, as long as your Play Online account is reduced to zero and all lottery draws in which you have purchased Entries have taken place.
  5. If you have funds remaining in your ‘Cash in - credit card’ pocket in your Play Online account, and you wish to close your Play Online account, you will need to contact Lotterywest Customer Services on (08) 9340 5200.

14. Responsible gaming and self exclusion

  1. Lotterywest is committed to Responsible Gaming and provides an online link to Problem Gambling Helpline information from the Play Online website. Contact details are available by clicking on the ‘Play Responsibly’ link on the website.
  2. You may request to be excluded from making an Entry at any time by completing and submitting a request to self-exclude which is accessible from the ‘Edit my details’ section, under ‘Personal Limits’ on the Play Online website. Once self-exclusion procedures have been completed, a self-excluded Play Online account holder will not be able to effect any Entry purchase for the duration of the nominated self-exclusion period.
  3. We may in our absolute discretion permanently exclude you from purchasing an Entry in which case we will remit the balance of your Play Online account to your nominated financial institution account, and terminate or block your Play Online account.
  4. Spending limits apply, and setting your own spending limit, under the Lotterywest limit, is available in the ‘Edit my details’ section, under ‘Personal limits’ on the Play Online website.

15. Legal proceedings and Western Australian jurisdiction

  1. You submit to the exclusive jurisdiction of the courts of Western Australia.
  2. You agree not to seek to stay or terminate any proceedings brought in Western Australia on the grounds that the forum is not convenient or is less appropriate than some other forum.
  3. You agree not to challenge any application made by us to stay any proceedings brought in any other jurisdiction.

16. Privacy policy – Use of personal information

  1. We collect information about you from the Application for Registration and from your transactions and use of this information may include your name, contact details, date of birth, identification details and details relating to your transactions and use of Play Online. We collect this information for the purposes of assessing and processing applications for registration, for general administration purposes, for carrying out marketing, market research, research, planning, product development, and administration of your Play Online account.
  2. You have the right to opt out of receiving marketing communications from us.
  3. You will usually be entitled to gain access to information which we hold about you, except in certain circumstances specified by legislation. If you wish to gain access to such information you can contact us. We may charge a fee for providing you with access to your personal information.
  4. If you do not provide all the information requested in the Application for Registration, except for those marked “optional”, we cannot process the Application for Registration.
  5. We may monitor your expenditure on Play Online. If your expenditure is at or near the maximum permissible level over the previous 12 months, we may contact you highlighting the availability of personal controls (spending limits/self-exclusion) and offer support in the form of access to a self-help questionnaire and problem gambling helpline information.
  6. We may report any suspicious activity with your Play Online account to relevant authorities without notice to you.
  7. All information collected by us by means of the Play Online Website shall become and remain our property.
  8. We use analytical tools to help track links you visit before, during and after accessing Play Online as well as overall activity on our website. We use this information to change and/ or improve Play Online Website and your experience on our site.

17. Privacy policy – disclosure of personal information to third parties

  1. We are committed to protecting your personal information at all times. This means any information we collect from you is securely transmitted and stored.
  2. You authorise us to disclose the information provided by you to us in your Application for Registration or subsequent hereto, to relevant financial institutions and our agents, contractors and sub-contractors for the purpose of validating and obtaining authorisation for any deposits made by you and for marketing, market research, research, planning and product development.
  3. We are not liable for any breach of the Privacy Act or use or misuse of player personal information by relevant financial institutions, Lotterywest agents and sub-contractors, or any other person to whom personal information is sent.
  4. A range of Government organisations have the power, under applicable legislation to require Lotterywest to disclose to them some or all of the information provided to Lotterywest.

We will also disclose your personal information if required to do so generally by law.

18. Security Policy

  1. We value the security of your information. We take numerous steps and precautions to ensure the security and privacy of your information.
  2. Lotterywest Play Online systems are designed and operated at high levels of security.
  3. We use Extended Validation (EV) SSL, the highest standard in the Internet security industry for website authentication, to secure your online transactions with us.
  4. We will not access your credit card details. Your credit card details will not be part of our operational system. All credit card transactions are secure and processed by BPOINT®, via the Commonwealth Bank of Australia.

19. General

  1. These terms and conditions and the Play Online Website and Lotterywest App are not and should not be understood in any way to be, advertising, promoting or inducing gambling, or publishing gambling information.
  2. A decision or determination of Lotterywest in relation to a draw or Entry and the declaration and payment of prizes under these rules and the relevant rules of lotto is final and binding on players.
  3. We own or are licensed to use the copyright in all of the content in the Play Online Website and by accessing the Play Online Website or Lotterywest App, downloading lottery results and purchasing an Entry through Play Online, you acknowledge our ownership and/or license.
  4. No content in the Play Online Website may be reproduced without consent and you agree that you will not interfere, modify or create other material from the Play Online Website or Lotterywest App.
  5. While considerable care has been taken in compiling and updating content in the Play Online Website we do not guarantee accuracy of such content.
  6. The Play Online Website may contain links to other sites not operated by us. We do not control those sites and cannot be held responsible for their content. Such links do not indicate endorsement or support of any goods, services or content on those sites and we will not be liable to any person for any goods, services or content which may be purchased or accessed through links to the Play Online Website where supplied by us.
  7. We cannot and do not guarantee that files available for downloading from the Play Online website will be free of viruses and/or codes that may corrupt or destruct properties. Players are responsible for implementing virus checking and other processes to prevent any such corruption or destruction. Files are downloaded and used by players at their own risk.
  8. You agree to indemnify us, our board members, officers, employees, agents, licensors and suppliers from and against all expenses, damages and costs, including reasonable legal costs, arising out of your use of the Play Online Website and any other Lotterywest website or from any violation of these terms and conditions (including negligent or wrongful conduct by yourself or any other person accessing the Play Online Website).
  9. We will be entitled at any time and without notice to assign any or all of our rights and duties under these terms and conditions and our agreement with you. Such registration is personal to you, and you may not transfer, assign or otherwise deal with your rights and obligations under these terms and conditions and our agreement with you.

20. Lottery rules

  1. The rules governing each lottery in which players can purchase entries through the Play Online website are contained in the following Lotterywest game rules which are made under the Lotteries Commission Act 1990 [as amended:
